Terms and Conditions of Service

These Terms and Conditions ("Agreement") govern the provision of travel planning and advisory services by Jenna Sais Quoi Travel ("Advisor") to the client ("Client"). By submitting a deposit or otherwise confirming a booking through the Advisor, the Client acknowledges having read, understood, and agreed to be bound by the terms set forth herein.

1.    Deposits and Payment Obligations

A.     Advisor service fees are compensation for professional planning, research, consultation, itinerary design, booking, and administrative services. Advisor fees are separate from supplier charges and are non-refundable once services have commenced, regardless of whether travel ultimately occurs.

B.      A non-refundable deposit is required to initiate and confirm any booking. The balance of the total trip cost shall be due and payable by the final payment date specified in the Client's itinerary documentation. In the event that final payment is not received by the specified due date, the Advisor reserves the right to cancel the booking without further notice, and any deposits previously paid shall be forfeited.

2.    Errors and Omissions Review Requirement

Upon receipt of travel documents, itineraries, confirmations, and invoices, the Client shall review all information for accuracy, including traveler names, dates, destinations, accommodations, and transportation details. The Client must notify the Advisor of any discrepancies within 24 hours of receipt. The Advisor shall not be responsible for losses resulting from the Client's failure to review and verify booking information.

3.    Cancellation Policy and Refunds

All cancellations must be submitted in writing to the Advisor. Cancellation fees are determined by the policies of the individual suppliers and service providers engaged on the Client's behalf and are frequently non-refundable, with penalties increasing as the departure date approaches. The Advisor will communicate applicable cancellation penalties to the Client at the time a cancellation request is received. The Advisor shall not be liable for any losses arising from supplier-imposed cancellation fees.

4.    Travel Protection

The Advisor strongly recommends that the Client obtain comprehensive travel insurance prior to departure, including but not limited to coverage for trip cancellation, trip interruption, emergency medical expenses, and emergency evacuation. The decision to purchase travel protection rests solely with the Client, and the Advisor shall bear no liability for losses that would otherwise have been covered under a travel insurance policy.

5.    Modifications to Confirmed Bookings

Any changes requested by the Client following confirmation of a booking may be subject to modification fees imposed by third-party suppliers. The Advisor will make reasonable efforts to accommodate such requests; however, the Advisor makes no representation or guarantee regarding the availability of modifications or the pricing implications thereof.

6.    Force Majeure Clause

The Advisor acts solely in the capacity of an independent travel advisor and Client advocate. The Advisor is not an employee, agent, or representative of any airline, hotel, cruise line, tour operator, or other third-party service provider. The Advisor shall not be liable for delays, cancellations, changes, losses, injuries, or expenses resulting from circumstances beyond the Advisor's control, including but not limited to natural disasters, severe weather, pandemics, epidemics, government actions, travel advisories, border closures, labor disputes, acts of terrorism, civil unrest, transportation interruptions, supplier insolvency, or other force majeure events.

7.    Supplier Insolvency and Financial Default

The Advisor shall not be responsible for the financial condition, bankruptcy, insolvency, reorganization, cessation of operations, or financial default of any supplier.

8.    Airline Schedule Changes

Airlines may alter schedules, equipment, routing, seat assignments, or flight times without notice. The Advisor is not responsible for such changes and recommends that Clients monitor airline communications directly. Any costs associated with schedule changes shall be the responsibility of the Client unless otherwise provided by the airline.

9.    Health, Safety, and Medical Responsibility

The Client assumes responsibility for assessing the suitability of travel based upon their physical condition, health status, mobility requirements, and medical needs. The Advisor is not qualified to provide medical advice and recommends consultation with appropriate healthcare professionals regarding vaccinations, medications, and health precautions.

10.   Traveler Conduct

The Client acknowledges that suppliers reserve the right to remove, deny service to, or refuse transportation to any traveler whose conduct is deemed unsafe, disruptive, unlawful, or otherwise inappropriate. The Advisor shall not be liable for any resulting losses or expenses.

11.   Chargeback and Payment Dispute Protection

By authorizing payment, the Client acknowledges receipt of the services described herein and agrees not to initiate a credit card chargeback for services properly rendered. Any disputes shall first be submitted to the Advisor in writing for resolution.

12.   Client Responsibilities Regarding Travel Documents and Entry Requirements

A.     The Client bears sole responsibility for ensuring that all travel documents, including passports and visas, are valid and sufficient for the intended itinerary. The Client is further responsible for verifying all applicable entry, health, and customs requirements for each destination country prior to departure. Entry requirements are subject to change without notice, and the Client is advised to consult the relevant governmental authorities or embassy of each destination country. The Advisor shall not be liable for any costs, losses, or delays resulting from the Client's failure to comply with applicable entry requirements.

B.      Many destinations require passports to remain valid for six months beyond the date of return and may require a minimum number of blank pages. The Client is solely responsible for ensuring compliance with all passport requirements.

13.   Acceptance of Terms

Submission of a deposit, final payment, or other authorization to book travel constitutes the Client's acceptance of these Terms and Conditions in their entirety.

14.   Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Nebraska. Any dispute arising under this Agreement shall be brought exclusively in the state or federal courts located within Nebraska, and the parties consent to the jurisdiction of such courts.

15.   Independent Contractor Status

The Advisor's role is limited to arranging travel services and providing advisory assistance. The Advisor does not own, operate, manage, supervise, or control any transportation provider, accommodation provider, cruise line, tour operator, or other supplier furnishing travel services.
